Consumer Lawyer in Coimbatore
Consumer complaints under the Consumer Protection Act — defective products, deficient services, insurance disputes, builder delays, and medical negligence.
Consumer claims pursued before the right forum, at the right time
Consumers are protected in India by the Consumer Protection Act, 2019, which provides a fast-track forum for complaints against defective products and deficient services. NS Law Firm's consumer lawyers in Coimbatore assist consumers in filing and prosecuting complaints before district, state, and national consumer commissions, and assist businesses in defending consumer claims fairly.
The most common matters in our consumer practice involve deficiency of service: insurers delaying or wrongly repudiating claims, builders failing to deliver or delivering with defects, banks and lenders imposing unfair charges, and service providers failing to perform what they promised. The Consumer Protection Act treats such failures as actionable deficiency, and compensation can include refunds, damages, and litigation costs.
Product liability is a growing area of the practice. Under the Act, manufacturers and sellers can be held liable for harm caused by defective products, and complaints can be pursued even where the harm is experienced through a third-party seller or e-commerce platform. We assess the defect, the causation, and the evidence before recommending the claim.
We also handle medical negligence claims, which require credible expert evidence and careful framing, and real estate consumer complaints, where the same facts can give rise to both RERA and consumer remedies. From the first legal notice to the final order and its execution, we manage the complaint with attention to the procedural timelines the Act prescribes.
Consumer remedies are time-sensitive. The Consumer Protection Act prescribes limitation periods and procedural requirements, and delay can prejudice the claim. We therefore assess matters promptly, confirm jurisdiction and limitation, and act on the client's instructions without unnecessary delay. Where a complaint succeeds, we follow the order through to execution, because an unenforced order is worth little to the client. For businesses that receive consumer complaints, we provide a different service: assessing the complaint, advising on the appropriate response, and defending claims where they are not made out, so that legitimate businesses are not compelled to pay claims they do not owe.

Frequently asked questions about consumer law
How do I file a consumer complaint?
A consumer complaint can be filed before the District Consumer Commission, State Commission, or National Commission depending on the value of the goods or services and the compensation claimed. The complaint requires copies of the invoices, correspondence, and evidence of the deficiency, and can also be filed online through the consumer commission's e-portal.
What is deficiency of service?
Deficiency of service means any fault, imperfection, or inadequacy in the quality, nature, and manner of performance of a service under a contract, including negligence in the performance of that service. Wrongful denial of an insurance claim, delayed possession by a builder, and failure to perform a paid service are common examples.
What are the limits for filing before each consumer commission?
Under the Consumer Protection Act, 2019, complaints up to Rs. 50 lakh go to the District Commission, between Rs. 50 lakh and Rs. 2 crore to the State Commission, and above Rs. 2 crore to the National Commission, based on the value of the goods or services and the compensation claimed.
Can I file a complaint against a builder for delay?
Yes. Delay in possession by a builder is a recognised deficiency of service, and consumers can claim compensation for the delay and related losses. In addition, complaints under RERA are available where the project falls within its scope, and the remedies under both regimes can be pursued in appropriate circumstances.
Can a medical negligence claim be filed before a consumer commission?
Medical negligence claims can be pursued before consumer commissions where a service is rendered for consideration and a deficiency is established. These claims require credible expert opinion and evidence connecting the treatment to the injury, and they are assessed on the standard of a reasonably competent medical professional.
How long do I have to file a consumer complaint?
A consumer complaint must ordinarily be filed within two years from the date on which the cause of action arose. The consumer commissions have the power to entertain a complaint filed after the limitation period where sufficient cause is shown, but that is an exception rather than the rule. Because delay can prejudice the claim and evidence can be lost, matters should be assessed and filed promptly, and we advise clients to preserve all invoices, correspondence, and documents from the very beginning.
